The FTC Seeks Public Comment on Harmful Commercial Surveillance and Information Security Practice

The Federal Trade Commission (FTC) is calling for public comment on commercial surveillance and information security practices that are detrimental to consumers. The agency is considering the implementation of new regulations or alternative measures to address how companies collect, protect, use, analyze, store, transfer, share, and sell private information.


In today's world, most Americans unknowingly provide personal information while performing basic tasks of modern life. Companies then use this data to develop and market products and services. However, some companies collect consumer data for one specific purpose but use it for other purposes, or sell it to advertisers, data brokers, and third parties.


The issue of commercial surveillance also extends to employers, who collect employee data to evaluate productivity. This practice has become more prevalent during the COVID-19 pandemic. With online services becoming essential for everyday life, consumers often have no choice but to accept companies' terms, even if they collect and monetize their information without their knowledge.


Consumers have little control over what happens to their information once collected, as they are often unaware of data brokers and third parties that collect and trade their information. The lengthy and complex privacy statements that companies provide can be difficult for consumers to understand and make informed decisions about the services they use.


Furthermore, companies may use the information they collect to direct consumers' online experiences beyond the products or services they signed up for, utilizing "dark patterns" practices that hide privacy settings and deceive consumers into providing personal information. These surveillance practices can have severe consequences, including cyberattacks, data theft, fraud, and identity theft.


The FTC is seeking public comment on this issue, which can have enormous financial and human costs. It is crucial to address harmful commercial surveillance and information security practices to protect consumers and the country's critical infrastructure.
